TERMS AND CONDITIONS
(ShuttleGo Platform – Republic of South Africa)

1. Introduction
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “Driver”, or “Passenger”) and ShuttleGo(“ShuttleGo”, “we”, “us”, or “our”).
By accessing or using the ShuttleGo platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree, you must immediately discontinue use of the platform.

2. Nature of Service

2.1 ShuttleGo operates as a transport service provider offering passenger shuttle and transportation services to users.
2.2 ShuttleGo employs and/or contracts drivers directly to provide transport services on its behalf. All drivers operating under the ShuttleGo platform act under the direction, control, and standards set by ShuttleGo.
2.3 ShuttleGo is responsible for the provision of transport services, including the management of bookings, assignment of drivers, and delivery of transportation to passengers.
2.4 While ShuttleGo may utilise digital technology to facilitate bookings and communication, the transport service is provided by ShuttleGo as a principal, and not merely as an intermediary platform.
2.5 Drivers engaged by ShuttleGo are required to comply with ShuttleGo’soperational policies, safety standards, and all applicable South African laws.

3. Eligibility
You warrant that:
• You are at least 18 years of age
• All information provided is accurate and complete
• You have legal capacity to enter into binding agreements

4. User Accounts
4.1 You are solely responsible for:
• Maintaining the confidentiality of your account credentials
• All activities conducted under your account
4.2 ShuttleGo shall not be liable for any loss arising from unauthorized use of your account.

5. Booking and Payments
5.1 Each booking constitutes a direct contractual agreement between the passenger and ShuttleGo.
5.2 Users agree to pay all applicable charges, including:
• Trip fares
• Cancellation fees
• Waiting time fees
• Cleaning or damage fees
5.3 ShuttleGo reserves the right to correct pricing errors and adjust charges where necessary.

6. Cancellations
6.1 Either party may cancel a booking subject to applicable fees.
6.2 Repeated or abusive cancellations may result in account suspension.

7. User Conduct
You agree not to:
• Engage in unlawful, abusive, or fraudulent conduct
• Damage property or vehicles
• Interfere with the operation of the platform
ShuttleGo reserves the right to suspend or terminate access without notice for violations.

8. Driver Compliance and Legal Requirements
Drivers warrant that they:
• Hold valid licences and permits
• Operate legally compliant vehicles
• Maintain all required insurance
• Comply with all applicable South African laws
Failure to comply constitutes a material breach of these Terms.

9. Standard of Service
Drivers undertake to:
• Provide services with reasonable care, skill, and diligence
• Ensure passenger safety
• Act professionally and lawfully at all times

10. Acceptance and Completion of Trips
10.1 Drivers are not obligated to accept trip requests.
10.2 Once accepted, drivers must make reasonable efforts to complete the trip.
10.3 Unjustified cancellations may result in penalties or termination.

11. Ratings, Monitoring and Enforcement
ShuttleGo reserves the right to:
• Monitor driver performance
• Investigate complaints
• Suspend or deactivate accounts

12. Insurance and Risk Allocation
12.1 ShuttleGo bear full responsibility for maintaining adequate insurance cover.
12.2 ShuttleGo shall not be liable for:
• Personal injury
• Death
• Property damage
• Loss arising from transport services

13. Driver Indemnity
Drivers indemnify ShuttleGo against any claims arising from:
• Their conduct
• Breach of law or these Terms

14. Termination
ShuttleGo may suspend or terminate accounts immediately and without prior notice where necessary.

15. Strict Limitation of Liability
15.1 To the maximum extent permitted by South African law:
ShuttleGo shall not be liable for any:
• Indirect, incidental, special, or consequential damages
• Loss of profits or income
• Personal injury or death
• Service interruptions
15.2 ShuttleGo’s total liability, if any, shall be limited to the amount paid by the user for the specific service in dispute.
15.3 The platform is provided “as is” and “as available” without warranties of any kind.

16. General Indemnity
You agree to indemnify ShuttleGo from any claims arising from your use of the platform.

17. Force Majeure
ShuttleGo shall not be liable for any failure or delay caused by events beyond reasonable control, including:
• Natural disasters
• Strikes
• Network failures
• Government actions

18. Dispute Resolution
18.1 Parties agree to first attempt to resolve disputes amicably.
18.2 If unresolved, disputes shall be subject to:
• Mediation; and if necessary
• Arbitration in accordance with South African arbitration laws

19. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of South Africa.
The courts of South Africa shall have exclusive jurisdiction, unless arbitration applies.

20. Severability
If any provision is found invalid or unenforceable, the remaining provisions shall remain in full force.

21. Entire Agreement
These Terms constitute the entire agreement between the parties and supersede all prior agreements.

22. Amendments
ShuttleGo may amend these Terms at any time. Continued use constitutes acceptance.
